The competence, or lack thereof, of courts to review Constitutional amendments in countries with written constitutions that are supreme, derives from the text, language and provisions of the said constitutions. Where the Constitution does not expressly grant such a power to the courts, judicial review of the merits of Constitutional amendments is not possible. Of course, the courts can always examine, and pronounce on, Constitutional amendments on the ground of failure to comply with the procedure for amendment to the Constitution.

The Ninth Amendment to the Constitution was tabled today in the House of Representatives. It comes out of June’s double nationalizations of Telemedia and BEL – and seeks to forever cement public majority ownership and control of Utilities.It also seeks to place the nationalizations on an unchallengeable footing – meaning that no matter which court says what – no private ownership group can ever again re-assume majority control of public utilities.

In August of 2009 – Prime Minister Dean Barrow went to the House of Representatives to take over BTL. When he did that 23 months ago, he surely didn’t expect that he’d have to go back two years later and do it all over again.
But that’s just what he had to do today to put an end to a week of corporate confusion at Telemedia where the Ashcroft Alliance was claiming and to some extent, trying to exercise control over Telemedia’s Affairs – even as the Government appointed board continued to occupy and run the place.

The Barrow Administration would go back to the National Assembly as soon as it could to re-re-nationalize Telemedia. Today he announced that the House Meeting has been set for Monday.

Telemedia is back under the control of the Aschroft Alliance. That is the consequence of a judgment handed down at 4:00 pm in the Court of Appeal. It found that the Government takeover of BTL in August of 2009 was unconstitutional – principally because it did not satisfy the definition of acquisition for a public purpose.

Arguments between the Ashcroft Alliance and the government of Belize were heard in late January, and after a long deliberation – the court will hand down a decision which could declare that the acquisition of BTL was unconstitutional. If it was, it could mean that the whole thing would have to be reversed. Now they say you can’t put the toothpaste back in the tube – and on Monday – after he had acquired another utility – the Prime Minister told us he’s confident government won’t have to do that – and it won’t have to go back to the house to put forth a new piece of legislation to re-acquire BTL, at least not right now

“Agreement” means the Agreement between the Government of Belize and the Government of the Portuguese Republic for the Exchange of Information Relating to Tax Matters, signed on the 22nd October 2010, as set out in the Schedule hereto;

For the purpose of complying with a request for information pursuant to the Agreement, the Financial Secretary
shall have power to obtain and provide all such information, including (without limitation):
(a) information held by banks, other financial institutions, and any person acting in any agency or fiduciary capacity including nominees and trustees;
(b) information regarding the ownership of companies, partnerships, trusts and foundations, including ownership information on all such persons in an ownership chain; in the case of trusts, information on settlors, trustees, beneficiaries and protectors; and in the case of foundations, information on founders, members of the foundation council and beneficiaries.
